Terms of Service

These Terms of Service ("Terms") govern your access to and use of WHV 417 Tracker (the "Service", accessible at mywhv.app). By creating an account or using the Service, you agree to these Terms in full.

The Service is operated by Filippo Cattaneo ("we", "us"). If you do not agree, do not use the Service.

1. Acceptance & eligibility

• You confirm you are at least 16 years old.
• You agree to provide accurate registration information and to keep it current.
• You are responsible for keeping your account credentials secret.

2. The Service

The Service helps backpackers in Australia track specified work days for the Working Holiday Visa subclass 417, including manual entry of work periods, AI-assisted payslip analysis (Pro feature), regional postcode validation, and progress visualization.

The Service is provided "as is" and "as available". We may change, suspend, or discontinue any feature at any time. We will give reasonable notice of material changes affecting paid users.

3. User accounts

• One account per person. Sharing accounts is prohibited.
• You may delete your account at any time from /account/delete. Deletion removes all your personal data within 30 days, except where we are legally required to retain certain records.
• We may suspend or terminate your account for violations of these Terms.

4. Acceptable use

You may not:

• Use the Service to commit illegal acts or to infringe the rights of others.
• Upload payslips that you do not have the legal right to process.
• Reverse engineer, scrape, or attempt to extract source code or non-public data.
• Submit false or misleading information about employers or work periods.
• Use automated systems to abuse the AI quota or generate excessive load.

5. Intellectual property

All Service software, branding, designs and content (excluding your own data) are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable right to use the Service for personal use.

Your data (work periods, payslip text extracted by AI, profile) remains yours. You grant us a limited license to process it solely to provide the Service.

6. Pro plan, billing & refunds

The free tier of the Service is available without payment, subject to feature limits.

The Pro plan unlocks AI payslip analysis up to the documented quota. Pro is billed via Stripe. Currency is shown at checkout.

Refunds

• Pro is a one-time purchase, not a recurring subscription.
• Refunds are available within 14 days of purchase if you have not used the AI quota beyond 5 analyses.
• To request a refund, email legal@mywhv.app with your account email.

7. No migration advice

The Service is an informational tool. It is NOT migration advice and does NOT replace the advice of a registered migration agent or the Department of Home Affairs ("DHA"). Visa eligibility decisions are made solely by the DHA.

Always verify regional postcodes, specified work definitions and current rules on the official DHA website. We make reasonable efforts to keep our data current, but we do not guarantee accuracy or completeness.

8. Disclaimers

• The Service is provided WITHOUT WARRANTIES OF ANY KIND, express or implied, to the maximum extent permitted by law.
• We do not guarantee uninterrupted availability, error-free operation, or that AI extractions will be 100% accurate. Always review AI-extracted data.
• You remain responsible for your own visa application and supporting documents.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, including loss of visa eligibility, deportation, lost income, or lost data, arising from your use of the Service.

Where liability cannot be excluded by law, our total liability is limited to the amount you paid us in the 12 months before the claim, or AUD $100, whichever is lower.

10. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest version. We will notify registered users of material changes by email at least 14 days before they take effect.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access for material breach of these Terms, with reasonable notice where practicable.

Sections that by their nature survive termination (IP, disclaimers, liability, governing law) will continue to apply.

12. Governing law & disputes

These Terms are governed by the laws of Western Australia, Australia, without regard to conflict-of-law rules. Disputes will be resolved in the courts of Perth, Western Australia.

If you reside in the European Economic Area, mandatory consumer protections of your country of residence still apply.
